Is Stamp Duty refundable?
Millions of pounds in overpaid stamp duty has been refunded to thousands of property owners. You too could be owed Stamp Duty Land Tax (SDLT) refunds if you are a property trader, investor or developer.
SDLT is a fixed tax paid by property buyers in England and Northern Ireland.
The rules around SDLT are incredibly complex and many solicitors who help buyers calculate how much they should pay are trained only to differentiate between residential and commercial property.
If they are relying simply on the HMRC calculator then they will, in many cases, be quoted a higher figure than it is possible to pay.
It is unlikely that your solicitor is familiar with the many irregularities and anomalies which, when fully understood can result in substantial refunds of SDLT.
Unless your solicitor gave you specific SDLT advice in relation to your purchase together with calculations etc., or they referred you to a specialist for advice on SDLT then it is highly likely that you will have paid more in SDLT than was necessary.
